Types of Divorce and Divorce Options
In Idaho when a marriage has ended there are many different grounds for divorce, different ways to approach divorce and options other than divorce.
Grounds for Divorce:
- Irreconcilable differences - this means you simply cannot agree on how to make the marriage work
The benefit of irreconcilable differences is that you do not have to prove anything and there are no laws denying divorce on these grounds. If you file for divorce on the other grounds, you must prove your case and there is a possiblity that your divorce may be denied.
Ways to Approach Divorce
- Collaborative Divorce - work together through one attorney
- Mediation/Dispute Resolution
Alternatives to Divorce
- Legal Separation - usually done to allow the property and debt to be separated but to allow health insurance for one party or the other to remain in force. This is like being divorced financially.
- Annulment - Court determines the marriage never existed.
- Reconciliation - if you have filed for divorce, but you wish to reconsider, the court will place your divorce on hold.
Different Types of Divorce
- Military Divorce - military divorce has some different issues than civilian divorce
- Contested Divorce - the parties are in disagreement about some aspect of the divorce
- Uncontested Divorce - the parties agree to the divorce and the terms of the divorce and want to agree in writing. This generally results in a very speedy divorce.
- Divorce with Domestic Violence
- Divorce with Criminal Law Issues
